Park, mom 'are both to blame for accident'

An amusement park and the mother of a 3-year-old girl severely injured in an accident share responsibility, the Shanghai No. 1 Intermediate People's Court has ruled.

The incident occurred on April 26, 2015, in a privately-owned amusement park in Minhang District when the mother, surnamed Cheng, left her daughter, nicknamed Xixi, alone and went to a nearby milk tea stall for a drink.

Xixi walked to an amusement ride, featuring spinning seats styled like coconuts. She was curious and tried to grab a "coconut" but was struck on the head and fell to the ground. A park worker heard her crying and carried her to Cheng.

Minutes later, Xixi vomited and fainted. Hospital checks showed a blood clot in her brain, a portion of which had been displaced due to pressure inside her skull. She received a craniotomy, which cost more than 180,000 yuan (US$26,665). Cheng and the park could not reach a settlement, so she sued.

The park was ordered to take 60 percent of the responsibility and pay 115,788 yuan. Cheng was ordered to take 40 percent of the responsibility.
