Baby hit by falling cement, proprietors take collective responsibility

Falling objects could be trouble for everyone living in a building

A baby girl hit by falling cement has been compensated over 360,000 yuan ($54,000) after court decision ruled that a majority of proprietors in a building should take the responsibility collectively, reports skb.com.cn.

In November 2014, the baby, just 40 days after her birth, was enjoying sunshine at Century Longcheng community in central China's city of Wuhan, when she was hit by a piece of cement falling from the apartment building above.

The baby girl was sent to hospital for treatment and later forensically identified with minor disabilities.

But both the family and the police were unable to find out who should be responsible for the incident.

Therefore, the baby's family sued 128 proprietors living on all 32 floors bar the first floor in the building.

The local court concluded in the first trial that 89 of the 128 proprietors should collectively compensate the girl and her family for over 360,000 yuan.

47 proprietors appealed but were rejected by a higher court as the lack of evidence cannot pinpoint suspects.
