US probes rubber resins imports over patent infringement

A U.S. trade panel on Wednesday launched a probe into rubber resins from various regions including China after the patent owner SI Group alleged its patent right was infringed.

The products at issue are synthetic rubber resins, including tackifiers used in the manufacturing of tires, said the U. S. International Trade Commission (USITC) in a statement.

The New York State-based SI Group filed a complaint with USITC on May 21 this year, alleging the importation of those products violated section 337 of the Tariff Act of 1930. It requested the USITC to issue an "exclusion" order and a "cease and desist" order.

The USITC said it had identified eleven respondents home and abroad, including China's Sino Legend Chemical Company and Shanghai Lunsai International Trading Company.

The trade agency is scheduled to set a target date for completing the investigation within 45 days after institution of the probe. USITC remedial orders in Section 337 cases are effective when issued and become final 60 days afterwards, which means banning importation of those products, unless disapproved by the U.S. Trade Representative within that 60-day period.

Section 337 investigations focus on allegations of a host of violations such as patent or registered trademark infringement or concerning the antitrust laws.
