Wife of man who died in custody sues police force

The wife of a 29-year-old man who died in a police raid on a foot massage parlor filed a case on Tuesday, accusing the police of intentionally causing injury, abusing their power and fabricating evidence.

The case was filed with the People's Procuratorate of Beijing Municipality on Tuesday morning, and the procuratorate is expected to issue a decision on accepting the case within a week, said Chen Youxi, an attorney in the case.

Lei Yang, a Beijing resident who recently became the father of a baby girl, died in police custody in Changping district on May 7.

The cause of Lei's death - which occurred minutes after police took coercive measures against him when he attempted and failed to escape - will be announced 15 days after an autopsy, The Beijing News reported.

According to a statement issued by Changping police on May 11, evidence at the foot massage parlor where Lei was arrested showed that he had paid 200 yuan ($31) for sex.

However, Lei's wife, who is surnamed Wu, insists there is no direct evidence such as surveillance video footage to prove that Lei solicited a prostitute, Chen told the Global Times on Tuesday.

The police could have forged evidence, including a condom containing Lei's body fluids, as they had access to Lei's body after his death, Chen explained.

Wu demanded that all police officers involved in his case who had abused their power, forged evidence or contributed to her husband's death be taken into custody and be investigated for criminal liability in accordance with the law, Chen said.
