Woman wins 50k yuan for bracelet hit by loose tiles

A property management company in Shanghai's Jing'an district has been ordered to pay a resident about 50,000 yuan ($8,035) for a jade bracelet that got damaged by a falling wall tile.

The plaintiff, surnamed Dai, sued her residential compound's property management company for about 90,000 yuan after several wall tiles fell on her while she was waiting for the elevator on August 10, according to a press release from Jing'an District People's Court.

The falling tiles hit her head and right foot. They also left a chink in her bracelet, which she bought for 80,000 yuan.

The company argued in court that it had recently taken over the compound at the time of the accident and had not yet finished checking out the state of its facilities. It also asserted that Dai could not prove that falling tiles damaged the bracelet.

In February, the court commissioned the Shanghai Commercial Mediation Center to evaluate the bracelet. The evaluation valued the bracelet at 50,000 yuan before it was damaged and 30,000 yuan after it was repaired.

Because the bracelet could not be restored to its original value, the court ruled that the company should purchase the bracelet from the plaintiff for a price equivalent to its value before it was damaged.
